This page (together with our Privacy Policy and Cookie Policy) provides information about UK Deed Poll Office LLC (“we”, “us”, “our”), a US-based company, and the legal terms and conditions (“Terms”) on which we provide our services, including drafting and issuing Deed Poll documents and providing our Secure Digi-Poll Deed Poll Subscription Service (together, the “Services”).

These Terms apply to any contract between us and you for the provision of Services (“Contract”). Please read them carefully before placing an order. If you do not accept these Terms, Privacy Policy and/or Cookie Policy, you will not be able to order Services from us.

1. Guarantee of Acceptance by UK Public Bodies (“Guarantee”)

1.1 Subject to clause 2 below, we guarantee that a Deed Poll issued by us will be accepted as evidence of your change of name by HM Passport Office, the DVLA, and other UK governmental bodies.

1.2 If our Deed Poll is refused by such a body, and none of the exceptions in clause 2 apply, we will provide a full refund of the document service fee.

2. Exceptions to the Guarantee

The Guarantee does not apply where:

a) The organisation notified is outside the UK;
b) You are not a British national or do not hold a British passport;
c) A child application is made without the consent of all persons with Parental Responsibility;
d) You fail to notify relevant organisations of your change of name;
e) You do not begin using your new name;
f) Your application contained incorrect or misleading information;
g) The Deed Poll was not properly signed or witnessed;
h) Required documents were not supplied to the organisation;
i) The organisation could not process the change for technical reasons;
j) The organisation considers the new name unacceptable;
k) You lack legal capacity to change your name;
l) You fail to supply written evidence of refusal;
m) You do not allow us reasonable time to review and respond to a refusal.

3. Refusal to Process Applications

We reserve the right to refuse to process any application. This includes where:

a) We believe the new name is intended for fraudulent purposes;
b) The change would be unlawful;
c) The name promotes hatred, discrimination, criminal activity or drug misuse;
d) In the case of a child, the name appears demeaning or inappropriate;
e) The name contains symbols, excessive length, or elements likely to be rejected by UK authorities.

4. The Process (Standard Deed Poll Service)

4.1 Provided we accept your application and your delivery address is within the UK:

• Orders received before 3pm on a working day will receive same-day email confirmation.
• Within 2 working days, we will dispatch by 1st class post:
  • Your Deed Poll document;
  • Any duplicate copies ordered;
  • Signing and witnessing guidance;
  • A suggested list of organisations to notify;
  • A draft covering letter template.

5. Cancellations, Corrections & Refunds

• Before Shipping: If you cancel your order before it has been shipped, we will issue a refund minus a £20.00 processing fee.
• After Shipping: Once your order has been shipped, you cannot cancel. As this is a personalised product, it is non-refundable if you change your mind.
• If We Make a Mistake: If we make an error on your Deed Poll, we will correct the mistake and resend your documents free of charge.
• If You Made a Mistake: If an error is caused by incorrect information you provided, we will correct and resend your documents at the cost of an additional copies order.
• Secure Digi-Poll Deed Poll Subscription Service: If you have purchased the Secure Digi-Poll Deed Poll Subscription Service, you may cancel it at any time by giving 30 days’ written notice. Cancellation will take effect 30 days after we receive your notice. Subscription fees remain payable during the notice period. No partial refunds will be provided for unused portions of a billing period unless required by law.
• Refund Method: Any refund will be issued using the original payment method within 30 days of our final decision.

Your statutory rights are not affected.

6. Secure Digi-Poll Deed Poll Subscription Service

6.1 The Secure Digi-Poll Deed Poll Subscription Service provides ongoing digital storage, access, authentication support, and related document management services as described on our Website at the time of purchase.

6.2 The subscription is provided on a recurring basis (monthly or annually, as selected at checkout) and will automatically renew unless cancelled in accordance with clause 5.

6.3 We reserve the right to suspend or terminate the subscription if:

• Payment is not received when due;
• You breach these Terms;
• We are required to do so by law.

6.4 We may amend subscription pricing upon reasonable notice. Any changes will take effect from the next billing cycle.

7. Confidentiality & Intellectual Property

7.1 All intellectual property rights in the Website and its content belong to us.

7.2 You may view, download and print content for personal use only. You may not reproduce, modify, distribute, or use content commercially without our written permission.

7.3 We will use reasonable endeavours to keep information provided by you confidential.

8. Limitations of Liability & Force Majeure

8.1 We shall not be liable for any failure or delay caused by events beyond our reasonable control (“Force Majeure”), including but not limited to natural disasters, war, civil unrest, strikes, power failure, system breakdown, cyber attack, or government action.

8.2 Delivery times may be extended during Force Majeure events.

8.3 Except as expressly stated in these Terms, the Services are provided without additional warranties to the fullest extent permitted by law.

8.4 We shall not be liable for:

• Indirect or consequential loss;
• Loss of profits or reputation;
• Financial penalties imposed by third parties.

8.5 Our total liability shall not exceed the total amount paid by you for the relevant Service.

8.6 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.

8.7 You must not misuse the Website by introducing malicious software or attempting unauthorised access.

9. Governing Law

These Terms and any Contract between us are governed by English law.

Any dispute shall be subject to the non-exclusive jurisdiction of the English courts. Residents of Scotland or Northern Ireland may also bring proceedings in their respective jurisdictions.
